5月上旬、女性の人工中絶権を認めた1973年の歴史的な“ロー対ウェイド”判決を覆す米連邦最高裁判所の判決草案が流出し、大きな論争を生む事態となっていましたが、昨晩米連邦最高裁判所が2018年から続いていた“Dobbs v. Jackson Women’s Health Organization”（※ ミシシッピ州唯一の中絶クリニックが、レイプや近親相姦も例外としない妊娠15週以降の中絶を全て禁止する同州のGestational Age Act法を巡り、州保健局の責任者を訴えた事件）に関する裁定を下し、流出した草案通り“ロー対ウェイド”の判例を覆す「中絶を憲法上の権利として認めない」判断を下したことが明らかになりました。

これに伴い、中絶の権利が州毎の判断に委ねられ、事前にトリガー法を可決済みの13州でまもなく中絶が禁止/違法化されるほか、ルイジアナ州では既にトリガー法の即時施行が明言される事態となっています。

5月に米連邦最高裁の草案が流出した際、BungieやDouble Fine、ArenaNetといった一部のスタジオが女性の権利を支持する声明を発表していましたが、今回の判決を受け、前回は沈黙を守っていた一部大手企業を含め、数多くのビデオゲーム開発スタジオやパブリッシャー、関連企業が女性の権利や従業員の支援を掲げる声明を発表しています。

中でも一部のスタジオは福利厚生の見直しや医療支援、旅費の給付といった具体的な従業員向けの支援を打ち出していますが、今回は一先ず様々な見解を提示したスタジオの声明をまとめてご紹介します。

余談ながら、米連邦最高裁は“Dobbs v. Jackson Women’s Health Organization”の判決が、3つの著名な判例グリスウォルド（避妊の権利）と、ローレンス（同性愛行為）、オーバーグフェル（同性婚）に対する疑問を示唆するものながら、中絶に直接関係ない判例に疑問を投げかけると理解されるべきではないと明記していますが、保守派のクラレンス・トーマス最高裁判事は過去の一部判例がデュー・プロセス（※ 法律に基づく適正手続）に基づいていなかったとして、グリスウォルドとローレンス、オーバーグフェルを含む（手続き的ではなかった）実体的判例を将来的に全て見直す必要があるとの見解を提示しており、今回の裁定が今後さらに大きな影響をもたらすのではないかとの懸念が高まる状況となっています。
